Administrative Review and Appeal

Administrative Review

You may request an Administrative Review with this department by completing an Internal Complaint Form (HR-024)(PDF, 147KB)  and submitting it within ten (10) calendar days from the date of this notice. If you do not submit your request within the ten-day limit, no administrative review will be conducted. Since an administrative review is a re-evaluation of an action taken, the discussion must be confined to facts and duties existing and authorized at the time of filing the application received on/before the closing date of the recruitment which served the basis for the recruitment action. Subsequent changes to the application will not be considered in the administrative review. A request for an administrative review shall not delay, prevent or invalidate the certification of names from the eligible list nor the appointment of a person from that list.

Appeal

If you do not agree with the administrative review decision or action taken by the Department of Human Resources, you may appeal to the County of Kaua‘i Civil Service Commission within twenty (20) days following the date your notice was sent. Any appeal to the Civil Service Commission must be completed on an Appeal Form located on the County of Kaua‘i Civil Service Commission webpage and submitted online. Copies of the appeal form can be picked up, mailed, or hand delivered to the Office of Boards and Commissions, 4444 Rice Street, Suite 300, Līhu‘e, HI 96766. A change in rating will not affect the employment consideration of referred applicants or an applicant's appointment.

AN ADMINISTRTATIVE REVIEW MUST BE FILED BEFORE REQUESTING AN APPEAL. THIS WILL EXPEDITE THE REVIEW PROCESS.

Examination

Unless otherwise specified in the recruitment announcement, applicants must qualify on an appropriate examination designed to measure applicants’ knowledge and skills necessary for satisfactory performance of the duties and responsibilities of this class of work. If you are required to report for a written, oral and/or performance test, you will be notified via e-mail of the date, time and place of the examination.

If you must take an examination but require special accommodation, auxiliary aid or assistance, please call the Department of Human Resources at (808) 241-4956 10 days before the testing date. We will design a fair and effective way in which you can demonstrate your ability to perform the essential functions of the job. You should be prepared to discuss and provide medical proof of your need for accommodation by a professional who is qualified to make a diagnosis.

NOTIFICATION: Applicants will be notified, in writing via e-mail, of your employment eligibility. You are responsible for monitoring instructions and correspondence from this office by checking your e-mail account in a timely manner. To ensure proper deliver, please make sure you:

Establishment of the Eligible List

Qualified candidates are placed on an eligible list in descending order, based on their examination scores and availability for employment. Referrals for job vacancies are made upon request from the hiring department/agency. In addition, veterans whose veteran's preference points enable them to equal or exceed the score of the lowest eligible will also be referred (ONLY FOR OPEN COMPETITIVE RECRUITMENTS).

The employing department/agency may select any one of the eligibles referred. The names of those not selected will be kept on an eligible list.

The eligible list is effective for at least six (6) months, and may be extended by the Director of Human Resources. The department will not withhold the referral of names of eligibles for employment consideration because of the applicant's failure to provide accurate and complete information concerning his/her qualifications.

Please Note: A notice of eligibility is not a job offer and just informs applicants that they have been placed on a list of qualified applicants.

Interview and Selection

Personnel from the department with the vacancy will contact the candidate on the eligible list to schedule interviews and/or conduct other selection process(es) based on job related requirements and departmental needs. Keep a copy of your application and bring it with you on the day you are scheduled. The department may select any candidate on the eligible list and will notify each person interviewed of the department's decision.

Employment Suitability

To determine the selectee's employment suitability, the Department of Human Resources and/or the appointing authority will conduct an evaluation of personal suitability to include reviewing information from the Hawai‘i Criminal Justice Data Center as applicable to the position.

Before being hired, the person selected must:

  • Complete a County medical examination, if applicable;
  • Be cleared to safely perform the physical and mental job requirements;
  • Pass a drug test as applicable to the position; and
  • Provide original documentation to verify identify and employment eligibility.

Probationary Period

For civil service positions, a six (6) month initial probationary period is in effect. During the probationary period, an employee is not entitled to rights to grievance procedures under any collective bargaining agreement. Additional limitations regarding applicability to contractual language may exist for employees in civil service positions who are serving initial probation periods.  A probationary period may also be extended under certain circumstances.

NOTE: This does not apply to appointed, exempt/temporary or contract hires. In addition, Police and Fire have initial probationary periods of twelve (12) months due to the nature of their job requirements.
