REQUEST FOR RELEASE OF FUNDS
On or about October 14, 2026 the Kauai County Housing Agency will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Planning/Congressional Directed Spending funds under Public Law 117-328 of the Consolidated Appropriations Act, 2023 and the Explanatory Statement for Division L of that Act, which was printed in the Senate section of the Congressional Record on December 20, 2022 (Explanatory Statement) to undertake a project known as Lima Ola Subdivision Offsite Water System Improvements for the purpose of design and construction of one (1) 0.3 million gallon County municipal water storage tank within TMK parcel (4) 2-1-001:049. The proposed project also includes the upsizing of two existing booster pumps that serve two existing 0.4-million-gallon water tank, along Kaumualii Highway, within TMK (4) 2-1-001:046. The booster pumps are planned to be upsized from 120 gallons per minute to 350 gallons per minute. The planned project includes required potable water service upgrades, as part of the County of Kauai Lima Ola affordable housing subdivision, which is located southwest of the project.
The project site is located approximately 1.7 miles northeast of downtown Eleele, along Kaumualii Highway, within Tax Map Key Parcels (4) 2-1-001:049 and (4) 2-1-001:046 and does not have a physical address.
FINDING OF NO SIGNIFICANT IMPACT
The Kauai County Housing Agency has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) file at the Kauai County Housing Agency, 4444 Rice Street, Suite 330, Lihue, Hawaii 96766 and may be examined or copied on weekdays 7:45 A.M to 4:30 P.M. or viewed at www.kauai.gov/housing.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the Kauai County Housing Agency, 4444 Rice Street, Suite 330, Lihue, Hawaii 96766 Attn: Steve Franco or via email to Steve Franco at sfranco@kauai.gov. All comments received by October 13, 2026, will be considered by the Kauai County Housing Agency prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The Kauai County Housing Agency certifies to HUD that Derek S.K. Kawakami in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Kauai County Housing Agency to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of fund and the Kauai County Housing Agency certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Kauai County Housing Agency; (b) the Kauai County Housing Agency has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD Honolulu Field Office at 1003 Bishop Street, Suite 2100, Honolulu, HI 96813 or submitted via email at CPD-R9-RROF@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.

Section 8 housing assistance payments to landlords may be delayed
LĪHUʻE – The County of Kauaʻi Housing Agency is advising landlords that Section 8 Housing Assistance Payments (HAP) may be delayed due to the effects of Hurricane Lowell and damage to County infrastructure from the Sept. 9 fire at the Kapule Building at the Līhuʻe Civic Center.
Timely payment to all program landlords remains a priority for the agency, and payments will be distributed as quickly as possible. County staff are working to return all County operations to normal as soon as possible.
Under the HAP contract and federal regulations, Section 8 Housing Choice Voucher program participants are not responsible for the housing authority’s portion of rent. Participants cannot be evicted or penalized for payment delays caused by the storm and fire-related disruptions.
Program participants are reminded that they must continue to pay their tenant portion of rent as required by their HAP contract and lease agreement.

PUBLIC NOTICE FOR AMENDED DRAFT ACTION PLAN FOR DISASTER MITIGATION
Amended Draft Action Plan for Disaster Mitigation(PDF, 1MB)
The Draft Action Plan for Disaster Mitigation covers grant requirements and KCHA’s intended use of a $585,000 Community Development Block Grant for Disaster Mitigation allocated to the County of Kauai in response to the 2018 flooding disaster.
The original plan to fund improvements to the Waimea and Hanapepe River Levees was Reprogrammed to support the construction of affordable multifamily rental housing in Kilauea.
The reason for reprogramming the funds is because the United States Army Corps of Engineers could not participate in the project under the presumed authorization, therefore CDBG-MIT funds, needed as a Federal match for USACE participation, were no longer needed.
Combining the CDBG-MIT funds with CDBG-DR funds to supplement increased costs associated with resilient building measures planned for the development provides increased resilience to residents of the housing community and to the surrounding community in the event of a disaster.

The purpose of the CP and the AAP is to ensure jurisdictions receiving federal assistance plan for housing and community development related needs in a way that improves availability and affordability of decent, safe and sanitary housing and creates economic opportunities for low- to moderate-income families in our community. The CP focuses on three areas of concern: housing, homelessness and community development. To receive funds made available under certain HUD programs, the County and State must have a housing strategy and CP that has been approved by HUD.
Documents, materials and information on how to apply for CDBG funding will be available at the public informational workshops. A recording of the virtual webinar will also be available on the website. Applications will be available from October 2, 2026 8:30 am through November 12, 2026 at 4:00 pm by reaching out to Anna Kanoho at iakanoho@kauai.gov. OPENING OF THE KAUAI COUNTY HOUSING AGENCY’S
HOUSING CHOICE VOUCHER (SECTION 8) WAITLIST
The Kauai County Housing Agency announces it will be opening its Wait List for the Housing Choice Voucher Program (Section 8). The Housing Choice Voucher Program provides rental assistance in the form of vouchers to low-income families and provides payments directly to landlords to offset the cost difference between tenant payments and unit rent.
To better serve applicants and to make the application process available to all, including those who are least likely to apply, the entire application process is available online at https://waitlistcheck.com/HI795 beginning on Tuesday, September 01, 2026, 12:00am (HST) until further notice. Program eligible applicants will be selected from the waiting list based on targeted funding or selection preference(s) for which they qualify, and in accordance with the PHA’s hierarchy of preferences, if applicable. Within each targeted funding or preference category, applications will be selected on a first come, first serve basis according to the time and date that pre-application is received. Only one application will be allowed per household. There is no guarantee for eligibility or rental payment assistance after applying.

The Housing Policy for the County of Kaua'i
The purpose of Ordinance No. 860 is to establish by law a housing policy in furtherance of the goals and objectives identified for the Kauaʻi County Housing Agency in Section 2-1.16 of the Kauaʻi County Code 1987. Ordinance No. 860 includes workforce housing requirements for residential and resort developments, and codifies procedures used to administer housing development programs. The Ordinance is effective June 10, 2008 as Ordinance No. 860(PDF, 165KB) .

2026 Income, Rental and For Sale Limits
Pursuant to Ordinance No. 860, US Department of Housing and Urban Development (HUD) provides the County with the Kaua'i median household income amount each year. In addition, HUD provides income limits, by household size, for extremely low income households that earn thirty percent (30%) of the median household income, very low income households that earn fifty percent (50%) of the median household income, households that earn sixty percent (60%) of the median household income, and low income households that earn eighty percent (80%) of the median household income. The Housing Agency provides Workforce Housing and Gap Group income limits utilizing the Kaua'i median household income and HUD's methodology.
